(di seguito identificata come il “Titolare”) makes the possibility of accessing and using the application available to all Users PointlyTM (di seguito identificata come “Applicazione”) of its exclusive ownership, which offers scouting and sharing of statistics for Volleyball (di seguito identificato come “Servizio”)).
Please read these terms and conditions carefully before using the Application. By downloading the Application from the respective Stores, the User accepts the Conditions and undertakes to respect them. If not, the User cannot use the Application.
The Owner may modify or update the Conditions of Use. Changes and updates will be binding as soon as they are published on the Application, therefore the User is invited to view the Conditions each time they access the Application.
1. Registration
To be able to use some features of the Application (the scout function in particular), Users must register by providing, truthfully and completely, all the data requested in the relevant registration form and fully accept the Privacy Policy and these Conditions.
The User is responsible for safeguarding their access credentials. The Owner cannot be held responsible in the event of loss, diffusion, theft or unauthorized use by third parties, in any capacity, of the login credentials of registered users.
2. Deletion of account from database
Registered Users may stop using the Products at any time, asking to deactivate your accounts or cancel them by contacting the Owner directly at the e-mail address service@pointlyscout.com.
In case of violation by the User of these Conditions or of the legal provisions, the Owner reserves the right to suspend or, in the most serious cases, terminate the User's account at any time and without notice.
3. Content inserted and sent by Users

The User is authorized to upload public domain content, provided that they represent the truth and are not in any way altered by his judgment.
The Owner will not be responsible for:
– any losses that are not a direct consequence of the breach of the Contract by the Owner;
– any loss of commercial or economic opportunity and any other loss, even indirect, possibly suffered by the User;

4. Licenses
Serplay S.r.l. owns all copyrights, brand names, domini, logo, distinctive signs, patents and other intellectual property rights associated with our Services. To enable us to make available and provide our Services, the User grants to Serplay S.r.l. a global license, not exclusive, royalty free, which may be sub-licensed and transferable to use, reproduce, to distribute, create derivative works, view and execute information (including contents) what a load, send, stores or receives on or through our Services. The rights granted in this license are intended solely to make available and provide our Services (for example in order to show the User profile image, viewing match statistics and results).
Serplay S.r.l. grants you a limited license, revocable, not exclusive, not sublicensable or transferable for use of our Services and in accordance with our Terms. This license is for the sole purpose of granting you the use of our Services in the manner permitted by our Terms. No license or right is granted herein, outside of what is expressly provided herein.
5. Data ownership
The User is aware that the Content sent will become public, as they can be viewed by anyone who has registered for the service PointlyTM. Serplay S.r.l. acquires ownership of the information entered into the systems PointlyTM or through our Services, this is to allow the processing of the Contents and the preparation of statistics, which are subsequently provided to Users. By loading the data into the system, the user implicitly declares that they have full possession of it and that they are free from ownership restrictions or limitations on use by third parties..
6. Links to third party sites
The Application may contain links to third-party sites. The Owner does not exercise any control over them and, therefore, is in no way responsible for the contents of these sites.

The data shared with Facebook for access through it is not in our possession, therefore we are not responsible for their use by third parties.
7. Causes of force majeure
The Data Controller cannot be held responsible for failure or delay in fulfilling its obligations set out herein, for circumstances beyond the reasonable and foreseeable control of the Owner. The fulfillment of the obligations by the Owner pursuant to these Conditions will be considered suspended for the period in which the Force Majeure Events occur. 8. Unilateral renunciation
No waiver by either party of any provision of these Terms will be effective, unless it is expressly stated to be a waiver and is communicated in writing.
9. Invalidity of clauses
If any provision of these Terms is illegal or invalid, it will not be considered as part of the General Conditions and this will not affect the remaining provisions which will continue to be valid to the maximum extent permitted by law.
10. Edit
The Owner reserves the right to modify, at any time, these Conditions by giving specific notice on the Application or on the relevant website. The User acknowledges and accepts that any changes to these Conditions will apply to orders sent by Users after the date of communication of modification of the Conditions.
11. Privacy
The protection and processing of personal data will take place in accordance with the Privacy Policy, which can be consulted on the page Privacy Policy , therefore reading is highly recommended.
